20 YEAR LIMITED WARRANTY WITH 10 YEAR FULL REPAIR OR REPLACEMENT ON GULL SUNCOIL SOLAR COLLECTORS

This warranty issued by Gull Industries, Inc., hereinafter referred to as GULL, applies to unglazed polymer absorber plates manufactured by it and purchased for use on swimming pools, spa, or hot tubs, and installed in the United States of America. It extends to the first retail buyer or to any other subsequent owners of the system.

GULL warrants that all unglazed polymer swimming pool solar collectors manufactured by it shall be free from defects in material and workmanship, will withstand the effects of freezing weather and will not fail from corrosion or from scale or deposits in the walls of its water passages. If a defect becomes evident within ten (10) years from the date of initial installation, GULL will repair, or at its option will replace the solar collector within a reasonable time and without charge for parts. The replacement may be new or factory rebuilt. GULL will pay for labor cost for repair removal or installation for the first five (5) years. The 6-10th year: GULL is responsible only for the cost of the replacement solar collector ? GULL INDUSTRIES will not pay for shipping after the first year.

In addition to the above warranty, GULL will grant a limited warranty at the expiration date of the tenth year after initial installation. If any warranty claim arises after the tenth year from initial installation, until twenty years from initial installation, GULL will replace or at its option, repair any solar collector which has been found to be defective, solely in material and workmanship, provided the purchaser pays to GULL, fifty percent (50%) of the published list price of the solar collector in effect at the time the defect is discovered within a reasonable time and without charge for parts. The replacement may be new or factory rebuilt. GULL WILL NOT PAY ANY LABOR COSTS FOR REMOVAL OR INSTALLATION AFTER THE TENTH YEAR OF THIS LIMITED WARRANTY. This limited warranty extends to the first retail buyer on whose premises the equipment is initially installed.

A. This warranty does not apply to solar collectors which have not been installed and maintained in strict compliance with GULL?s installation and operating manuals and instructions and/or applicable ordinances or codes.
B. This warranty does not apply to conditions resulting from misuse, neglect or accident, or to solar collectors which have been damaged by extraordinary or abnormal weather conditions or other cause, thing, person or act of God.
C. This warranty does not apply to any solar collector which has been damaged by internal freezing if all applicable GULL installation, operation, and maintenance instructions have not been observed.
D. This warranty does not apply to conditions resulting from attempts at repair or alteration by anyone other than a person authorized by GULL to do such repairs or alterations.
E. This warranty does not apply to any solar collector on which the serial number/date code label, if present, has been altered, effaced or removed.
F. No particular level of thermal performance of savings in fuel costs is warranted.
G. This warranty does not cover installation hardware, accessories of any components or part which is not part of the solar collector.
H. GULL 4000, its distributors, or its dealers will not be liable for consequential damages such as damage to your home, inconvenience, loss of time or use of your solar heating system as a result of the breach of warranty. SOME STATES DO NOT ALLOW THE EXCLUSIONS OR LIMITATIONS OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU.
I. GULL will not be responsible for costs associated with the investigation or analysis of an alleged defect of any repair charges for claims which you may make which are not covered by this warranty.

To obtain service on the solar collector, you must notify the installing dealer of the GULL authorized service dealer and give the dealer the specific nature of the defect or malfunction within thirty (30) days from the discovery of any defect. Failure to provide notification within thirty (30) days after discovery of the defect may be deemed a waiver of the warranty in certain states. Within a reasonable period from the time GULL has been notified, GULL will provide a repair method or replacement in accordance with this warranty. To verify that the warranty is still in effect you must furnish evidence of the date of completion of installation to the GULL dealer. If you are unable to provide GULL with proof of date of installation, the basis for determining warranty eligibility will be based on the manufacturing date of the solar collector. This is the only warranty given to you covering this product. No other warranty whether written or verbal, shall be binding on GULL INDUSTRIES, INC.

20 YEAR LIMITED WARRANTY WITH TEN YEAR FULL REPAIR OR REPLACEMENT ON GULL POLY PRO SOLAR COLLECTORS AND HARDWARE INCLUDING FREEZE DAMAGE

This warranty issued by Gull Industries, hereinafter referred to as "GI", applies to all solar collectors with unglazed polymer absorber plates manufactured by it and purchased for use on swimming pools, spas, or hot tubs, and installed in North America (the United States, Canada and Mexico). The ten year parts warranty extends to the first retail buyer and any subsequent owners on whose premises the equipment is initially installed.

GI warrants that all unglazed polymer swimming pool solar collectors manufactured by it shall be free from defects in material and workmanship, will withstand the effects of freezing weather and will not fail from corrosion or from scale or deposits in the walls of its water passages. GI also warrants that all mounting hardware, hoses, hose clamps, pipe adapters, strapping and end caps (hereinafter referred to as "hardware") shall be free from defects in material and workmanship and will not fail from corrosion or scale and will withstand the effects of freezing weather. If a defect becomes evident within ten (10) years from the date of initial installation, GI will repair, or at its option, replace the solar collector or hardware within a reasonable time and without charge for parts. The replacement parts may be new or factory rebuilt. IF GI OPTS TO REPLACE THE SOLAR COLLECTOR OR HARDWARE, GI WILL NOT PAY OR BE RESPONSIBLE FOR ANY LABOR COSTS FOR REMOVAL OR INSTALLATION UNLESS A SEPARATE LABOR WARRANTY HAS BEEN PURCHASED FROM GI.

C. This warranty does not apply to conditions resulting from attempts at repair or alteration by anyone other than a person authorized by GI to do such repairs or alterations.

F. This warranty does not cover other accessories, components or parts such as, but not limited to ball valves, check valves, and vacuum relief valves which are not part of the solar collector or expressly warranted herein.

GI, its distributors, or is Master Dealers will not be liable for consequential damages to your home, inconveniences, loss of time or use of your solar heating system as a result of a warranty claim or the breach of this warranty. SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATIONS OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU.
H. GI will not be responsible for costs associated with the investigation or analysis of an alleged defect or any repair charges for such claims which you may make which are not covered by this warranty.

To obtain service on the solar collector or hardware, you must notify the Master Dealer or the GI authorized service dealer and give the dealer the specific nature of the defect or malfunction within thirty (30) days from the discovery of any defect. Failure to provide notification within thirty (30) days after discovery of the defect may be deemed a waiver of the warranty in certain states. Within a reasonable period from the time GI has been notified, GI will provide a repair method or replacement in accordance with this warranty. To verify that the warranty is still in effect, you must furnish evidence of the date of completion of installation to the GI dealer. The warranty registration card is not a condition precedent to coverage under this warranty, but its prompt return may eliminate the need to establish further proof of purchase. If you are unable to provide GI with proof of the date of installation, the basis for determining warranty eligibility will be based on the manufacturing date of the solar collector.

Except for a separate labor warranty purchased by the first retail buyer at or before the time of installation, this is the only warranty given to you. No other product warranty whether written or verbal, shall be binding on Gull Industries, its distributors, or its Master Dealers.

Your satisfaction and good will are of primary concern to Gull Industries. In the event a warranty matter is not handled to your satisfaction, the following steps are suggested:

20 YEAR LIMITED WARRANTY WITH 20 YEAR FULL REPAIR OR REPLACEMENT ON GULL 4000 AND 5000 SERIES ABSORBER PLATES

This warranty issued by Gull Industries, Inc., hereinafter referred to as GULL, applies to unglazed and glazed solar collector plates manufactured by it and purchased for use on swimming pools, spa, or hot tubs, water heating or space heating, and installed in the United States of America. It extends to the first retail buyer or to any other subsequent owners of the system.

GULL warrants that all metal solar collectors shall be free from defects in material and workmanship. If a defect becomes evident within twenty (20) years from the date of initial installation, GULL will repair, or at its option will replace the solar collector within a reasonable time and without charge for parts or labor. The replacement may be new or factory rebuilt. GULL will not pay for shipping after the first year.

A. Conditions resulting from a defect in a component or part which is not part of the Gull Industries collector.
B. Conditions resulting from a significant departure from Gull Industries installation instruction.
C. Conditions resulting from failure to provide reasonable and necessary maintenance in accordance with Gull Industries Operating and Maintenance instruction.
D. Conditions resulting from any misuse, abuse, negligence, accident, or neglect, or to conditions which result in freezing, wind, hail, or other natural causes beyond the control of Gull Industries.
E. Fading or deterioration of exterior painted or anodized surfaces.
F. Conditions resulting from repair or alteration by anyone other than Gull Industries or a person duly authorized by Gull Industries to do such repair or alteration.
G. Any glass breakage.
H. Low PH, alkalinity, over chlorination of pool, electrolysis or scale deposits in collector tubes.
I. No particular level of thermal performance or savings in fuel costs is warranted.
J. Excessive water flow resulting in erosion of copper waterways recommended flow not to exceed 5 gallons per minute per collector.
K. Installation hardware, accessories of any component or part which is not part of the solar collector.
L. GULL 4000, its distributors, or its dealers will not be liable for consequential damages such as damage to your home, inconvenience, loss of time or use of your solar heating system as a result of the breach of warranty. SOME STATES DO NOT ALLOW THE EXCLUSIONS OR LIMITATIONS OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU.
